1. General Provisions

  • Order: A Buyer's request to purchase Goods, placed on the Website.
  • Offer: This public offer is addressed to an indefinite circle of persons.

 

Subject Matter of the Agreement: Sale of Goods through distance selling under the terms and conditions set forth in this Offer.

Moment of Conclusion of the Agreement: The Agreement shall be deemed concluded from the moment the Buyer accepts the terms of the Offer by placing an Order on the Website. Acceptance of the Offer is deemed to be the Buyer's actions indicating unconditional acceptance of all terms of the Offer (clicking the "Place Order" button).

2. Rights and Obligations of the Seller

  • Provide information about the Goods: Description, characteristics, price, availability, delivery terms, and payment terms.
  • Deliver Goods of proper quality: Corresponding to the description on the Website.
  • The Seller reserves the right to change the technical characteristics of goods without notifying the Buyer: Technical characteristics of paper, ink, films, stickers, and badges may actually differ from those indicated on the website and in the Seller's newsletter, while the purpose of the goods remains unchanged.
  • Ensure timely order processing: In accordance with the delivery method chosen by the Buyer and the specified address.
  • Inform the Buyer of the fact of shipment: By sending a notification to the Buyer confirming the shipment of the goods with a tracking number.
  • Inform the Buyer of upcoming events: By sending out an email newsletter.

3. Rights and Obligations of the Buyer

  • Familiarize themselves with the terms of the Offer before placing an Order.

  • Pay for the Goods in full in accordance with the chosen payment method.
  • Provide accurate information about themselves when placing an Order.

4. Payment and Delivery Procedures

  • Delivery times: Average delivery times for regular shipments are 15-20 days, average delivery times for priority shipments are 10-14 days. Delivery times depend on the destination country, the speed of customs clearance, the speed of processing the shipment by the postal service, and the speed of direct transportation by the postal service. The Seller cannot influence these circumstances.
  • Responsibility for the safety of the Goods: The risk of accidental loss or damage to the Goods passes to the Buyer from the moment the Goods are transferred by the Seller to the postal service. In case of damage or loss of the goods due to the fault of the postal service, the Goods may be resent without charge at the Buyer's request.

5. Liability of the Parties

Seller's Liability:

  • For sending Goods of proper quality.
  • The Seller is not responsible for color shades, as they may differ depending on the Buyer's monitor settings and the Buyer's color perception.

Buyer's Liability:

  • For providing inaccurate information when placing an Order. The recipient's data and address must be accurate and error-free.
  • For unreasonably refusing to accept the Goods.

6. Return of Goods

  • Conditions for returning Goods of proper quality: Due to technical features, the goods are not subject to exchange or return.

In case another item was sent by mistake or the item was critically damaged during delivery, the Buyer may be sent the item again without charge upon the Buyer's request and if there are photo or video materials confirming the fact of these events.

7. Force Majeure

  • Circumstances beyond reasonable control: Natural disasters, military actions, strikes, decisions of state bodies that hinder the performance of obligations under the contract.
  • Exemption from liability: A party that has failed to perform or improperly performed its obligations under the contract due to circumstances beyond reasonable control is exempt from liability for non-performance or improper performance of such obligations.

8. Dispute Resolution
  • Claims: All disputes and disagreements shall be resolved through negotiations. If it is not possible to reach an agreement, the dispute shall be referred to a court at the location of the Seller.

9. Other Terms
  • Confidentiality: All Buyer data is processed by the store platform and the payment system. The Seller only has access to the data necessary to fulfill its obligations to send the goods to the Buyer. The Seller undertakes not to disclose the Buyer's personal data, except in cases provided by law.
  • Notifications and mailings: The Seller has the right to use the Buyer's email address to inform them about the status of the order, as well as to conduct informational mailings through irregular intervals.
  • Changes to the Offer: The Seller has the right to make changes to the Offer unilaterally without notifying the Buyer.
  • Term of the Offer: The Offer is valid until it is canceled by the Seller.

10. Warranties on Goods
  • Warranty period: Due to the technical features of the goods, no warranty is provided for the goods sold.

11. Intellectual Property
  • Prohibitions: All rights to images, text, trademarks, graphic and multimedia materials posted on the website belong to their authors. Any copying, distribution, use, modification, and other similar actions are prohibited without the written consent of the authors.

12. Limitation of Liability
  • Seller's liability limitation: The Seller is not responsible for any indirect damages, lost profits, or other losses arising from the use or inability to use the Goods, as well as in case of loss or damage of the goods by a third party. The Seller's maximum liability is limited to the cost of the purchased Goods. The Seller is not responsible for delays in delivery; the postal service is responsible for this according to the agreement concluded between the Seller and the postal service.

  • Cost and terms of providing services: Agreed upon separately depending on the service.

14. Procedure for Considering Claims
  • Filing a claim: All claims are submitted electronically to the email address with attached photo and video materials.
  • Timeframe for considering a claim: The Seller makes every effort to resolve the claim as soon as possible. The Seller considers claims within 7 calendar days. If it is necessary to additionally contact the postal service or a third-party organization as a result of the consideration, the consideration period may be extended, of which the Seller undertakes to inform the Buyer.
  • Dispute resolution procedure: All disputes and disagreements shall be resolved through negotiations. If it is not possible to reach an agreement, the dispute shall be referred to a court at the location of the Seller.

15. Personal Data
  • Collection and processing of personal data: When placing an Order, the Buyer provides their personal data according to the form on the Website.
  • Payment security: Payment is made through a payment system; all payment data is stored in the payment system, and the Seller does not have access to the Buyer's payment data.
  • Purposes of data processing: Placing and fulfilling orders, informing about the progress of order processing, informing about new goods and services.
  • Consent to the processing of personal data: By placing an Order and clicking the "Place Order" button, the Buyer gives their unconditional consent to the processing of personal data for the above purposes.

16. Other Terms

  • Changes to the Offer: The Seller has the right to make changes to the Offer unilaterally without notifying the Buyer.
  • Applicable law: The law of the country of registration of the legal entity directly selling the goods applies to the contract.
